Advia Terms of Service

Version 1.5 — effective upon acceptance.

These terms are the agreement between Advia Inc. ("Advia") and the client organization named on the account. The person accepting them confirms they are authorized to accept for that organization. They apply to every service Advia performs for the account.

1. The services

Advia provides real estate field services in the Greater Toronto Area: open house sign installation and collection, post sign installation and monthly rental, riders, sign storage, and related field work. Advia takes every order; work is performed by Advia's crew or by contractors working under Advia's direction. Your relationship, your pricing, and your invoice are with Advia in every case.

2. Ordering, cutoffs, and the service window

  • Weekend open house orders close Friday at 5:00 PM Eastern. After the cutoff, acceptance of a late order is Advia's decision, not an entitlement.
  • Installation begins Friday evening and may continue into Saturday morning. A sign placed by Saturday morning is on time.
  • Collection happens at the end of the service window. Some signs are collected Saturday night, others Sunday night, matching the days you ordered.
  • An order cancelled after the Friday cutoff may carry a cancellation fee, because crew and routing were already committed to it.

3. Placement

Advia designs sign coverage using its professional judgment of traffic, visibility, and municipal rules. You may request specific placements; final positioning in the field is Advia's call.

  • Municipal bylaws take precedence over any requested placement.
  • Advia does not place signs on private property without the property owner's permission.
  • If a planned location cannot be used, the crew relocates the sign to the nearest workable position and the placement is recorded.

You confirm that you are entitled to advertise each listing you order signs for.

4. Who owns what

  • Your signs are yours. Open house signs, for-sale boards, and riders carrying your name or branding remain your property while Advia installs, collects, and stores them.
  • Posts are Advia's. Installation posts (metal, wooden, double) are Advia's rental assets and never become your property. Generic, unbranded riders are Advia's.
  • Post rental: a post is free for the first 90 days after installation, then monthly rental applies at the current rate until the post is removed. You are notified before rental begins.

5. Signs in the field

Signs stand in public space, unattended, in all weather. By ordering, you accept the risks that come with that.

  • Theft, vandalism, weather damage, and removal by a municipality or third party are your risk, not Advia's. Advia reports these events; it does not insure against them.
  • Advia is responsible when the loss is Advia's doing — a sign lost or damaged through demonstrable crew error is made right by Advia.
  • Every completed job ends with a report to you stating what was collected and whether anything is missing or damaged. That report is the record of the job.

6. Storage

Signs stored between weekends are kept at Advia's facility.

  • Storage is billed monthly based on the signs you store, per Advia's current storage schedule, and waived in any month with a billable installation.
  • Advia is responsible for your stored signs up to their replacement cost. A sign that is lost or damaged in Advia's storage is replaced or credited at replacement value.

7. Billing and payment

  • Your account accrues charges as work is performed, and your current balance is visible in your portal at any time.
  • One invoice per month covers everything: installations, post rentals, storage, and any fees. Invoices are issued at the start of the following month.
  • Invoices are payable upon receipt.
  • New accounts prepay. Advia may require payment at the time of ordering, through the payment method on file, before work is scheduled. Accounts approved for monthly invoicing are billed as described here.
  • Zone surcharges apply once per order per the current schedule for far and extended areas.
  • Incident fees — field damage, rider swaps, after-cutoff cancellations — are charged when the event is recorded. Every fee is reviewed by Advia before it reaches an invoice, and every fee line states what caused it.
  • Prices are subject to HST.

8. Late payment

  • Every invoice is payable upon receipt and carries a 30-day interest-free period from its issue date. An invoice inside that period is outstanding, not overdue. Paying within it costs nothing extra.
  • An invoice still unpaid more than 30 days after it was issued is overdue, and the unpaid balance carries simple interest at 2% per month (24% annually), calculated daily and counted from the invoice's issue date. The interest-free period waives the charge for those who pay within it; it does not delay the clock. Interest does not compound.
  • If any invoice remains unpaid 90 days after it was issued, Advia may suspend new orders and continue to hold stored signs as security until the account is brought current.

9. Liability

Signs are installed at your request and for your benefit. Except where these terms state otherwise:

  • Advia is not liable for injury, damage, or loss caused by or related to an installed sign, including incidents involving third parties, vehicles, or property.
  • Advia is not liable for indirect or consequential loss, including a lost sale or a missed open house.
  • Advia's total liability for any claim is limited to the amount you paid for the order the claim arises from.

Nothing in these terms limits liability that cannot be limited under Ontario law.

10. Ending the relationship

Either side may end this agreement with written notice. On ending:

  • Outstanding balances become due on the final invoice.
  • Rented posts still in the field are removed promptly; rental is billed to the removal date.
  • Signs in Advia's storage are held as security for the account. Advia retains possession of stored signs as collateral for any outstanding balance and releases them once the account is paid in full. Released signs are returned to you or made available for pickup; a delivery or pickup fee may apply.

11. Changes to these terms

Advia may update these terms.

  • For minor changes, Advia notifies you in your portal or by email, and your continued use of the services after the stated effective date is acceptance of the change.
  • For material changes — pricing rules, liability, or payment terms — you will be asked to review and accept the new version in your portal before continuing to order.
  • The version you accepted, or were notified of, remains the record of what applies to your account.

12. Governing law

These terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario.
